Welcome to the Waivers and Rental Agreement page of Portable Paradise Spa Rental. We take safety and transparency seriously. Before diving into the refreshing experience of our portable spas, understand the Terms, Financial Responsibilities, and Liabilities associated with your rental. This agreement, to be signed ensures that our customers fully comprehend the responsibilities that come with renting our top-notch spa equipment. Got questions? Portable Paradise Spa Rental Agreement 

This rental agreement is entered into by the Renter (______________________________) and Portable Paradise Spa Rental LLC. This agreement lists the rules, debts, and responsibilities the above stated Renter agrees to abide by went renting Portable Paradise Spa  Rental Equipment.  

  1. Late Fees: Renter agrees to pay an extra $100 per day if the Equipment is returned late due to renter negligence or unresponsiveness. 
  1. Card Kept on File: The Renter agrees to have their card saved on file and charged in the case of repairs due to misuse, neglect, abuse or intentional acts. 
  1. Missing Equipment: The renter is responsible for any missing equipment listed in this agreement. If a piece of equipment is missing charges may be applied as well as law enforcement notification. 
  1. Equipment: This term in the contract constitutes the following. 

 

  1. 1 Softub spa 
  1. 1 Hydromate water pump and Heater 
  1. 1 Softub Lid 
  1. 1 Tub cover 
  1. 1 Chemical kit including, test strips, PH up/down, and chlorine. 
  1. 1. Poolaza Hot Tub Skimmer 
  1. 1. Set Measuring spoons. 

 

  1. Responsibility for Damage: The Renter shall be responsible for any damage to the Equipment caused by misuse or abuse and be charged for these damages. 
  1. Responsibility for Death/Injury: The Renter will be responsible for any incident resulting in death or Injury while the Equipment is under their supervision. Even after the allotted rental period has past until the Equipment is picked up by Portable Paradise Spa Rental LLC. 
  1. Maintenace For Long Term Rentals: Equipment being rented out for 3 days or longer is considered a long-term rental. During these extended periods it will be the responsibility of the renter to maintain PH and chlorine levels in the Softub. Chemicals, test stripes, and instruction will be provided to the customer for them to competently complete this requirement.   
  1. Chemicals: The Renter will follow all health and hazard guidelines posted on the bottles of all water management chemicals.   
  1. Default: The occurrence of anyone or more of the following events will constitute an event of default of accrued charges. 
  1. The Renter fails to pay any amount provided for in this agreement when such amount is due or otherwise breaches the Renters obligations under this agreement. 
  1. The Renter becomes insolvent or makes an assignment of rights or property for the benefit of creditors or files for or has bankruptcy proceedings instituted against it under the Federal bankruptcy act of the Unites States. 
  1. Remedies: In the event of default Portable Paradise Spa Rental LLC will be entitled to pursue any one or more of the following actions. 
  1.  Declare the entire amount of the rent or the term immediately due and payable without notice or demand to the renter. 
  1. Commence legal proceedings to recover the rent and other obligations accrued before and after the event of default.  
  1. Take possession of the equipment, without demand or notice, wherever it may be located, without any court order or other process of law. The Renter waives any and all damage occasioned by such taking of possession. 
  1. Pursue any other remedy available in law or equity. 
  1. Compliance with Laws: The Renter shall comply with all applicable federal, state, and local laws, rules, and regulations in connection with the use of the Equipment. 
  1. Use of Equipment:  

                a. The Renter will use the equipment in a safe and careful manner and comply with all        of the manufacture's guidelines and recommendations. The Renter will respect the        equipment with any applicable law whether local, state, or federal.  

                 b. The Renter will only use the equipment for its intended purpose.  

       c. The Renter shall not damage or abuse the equipment in any way or else be responsible for damages and replacement financially. 

                 d. THE RENTER ASSUMES ALL RISKS ASSOCIATED WITH AND FULL RESPONSIBILITY FOR THE POSSESSION, CUSTODY AND OPERATION OF THE EQUIPMENT, INCLUDING, BUT NOT LIMITED TO, RENTAL CHARGES, PROPERTY DAMAGES AND DESTRUCTION, LOSSES, PERSONAL INJURY, AND DEATH. THIS RESPONSIBILITY IS INEFFECT DURING THE FULL TIME FRAME OF THE RENTAL PERIOD. 

                 e. Renter will maintain possession of the equipment and will not sublease, sell the equipment, or assign the equipment to a third party. 

  1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Florida without giving effect to any principles of conflicts of law. 
  1. Entire Agreement: This Agreement contains the entire understanding of the parties relating to the subject matter hereof and supersedes all prior agreements and understandings, whether oral or written. 
  1. Amendment: This Agreement may be amended or modified only by a writing signed by both parties. 
  1. Rental Intervals: The rental intervals are in 24 hour (day) increments and starts at the time of equipment drop off. At the end of the rental period the equipment must be available to be picked up or late charges will be applied. The equipment may be returned earlier than the intended period. However, a refund of the unused days will not be deducted from the agreed upon price made at the time of equipment delivery. The renter will not be charged any late fees in the event of a late collection of equipment by Portable Paradise Spa Rental LLC 
  1. Transportation: Transportation will be free for all drop offs at locations within a radius of 40 miles from the owner's location. Any additional mileage beyond 40 miles will be an additional charge of $1 per mile charged to the renter. The renter is not allowed to transport the equipment on their own to save money or for any other reason, it must be picked up and delivered by Portable Paradise Spa Rental LLC 
  1. Theft: If the listed equipment is stolen while in the care of the Renter. The Renter will be responsible for replacement costs until the equipment is recovered; minus any damaged good fees. Please take care of locking up all equipment in a secure/locked location and call immediately in case of 3rd party theft or vandalism. 
  1. Law Enforcement Notification: Failure to return equipment without notification or processed charges will lead to notification of law enforcement. The listed equipment will be considered stolen, and the appropriate charges will be filed.   
  1. Indemnity: The Renter will indemnify and hold harmless Portable Paradise Spa Rental LLC against any and all claims, actions, suits, proceedings, costs, expresses, damages and liabilities, including attorney’s fees and costs, arising out of or related to the Renters use of the equipment.  

IN WITNESS WHEREOF, the parties have executed this Agreement as of the date first below written. 

This Agreement contains the entire understanding of the parties regarding the subject matter hereof and supersedes all prior agreements and understandings, whether oral or written. This Agreement may not be amended or modified except in writing signed by both parties.
